What Employers Need to Know

If employers use background checks in making employment related decisions including hiring, firing, promotion or reassignment, they must comply with the Fair Credit Reporting Act (FCRA) and other laws that protect people from discrimination. Additionally the Equal Employment Opportunity Commission (EEOC) enforces such laws and can even bring legislation in instances of disparate impact which is still considered discrimination.  These resource links will bring you to the Federal Trade Commission’s (FTC) website and the FTC and EEOC will layout tips and advice for businesses on the lawful use of background information.
